GENERAL TERMS AND CONDITIONS

In the event of questions of interpretation between the different language versions of these contractual conditions, only the German version shall be authoritative.

The following conditions apply to all registrations for courses offered by the sailing school Lakefly.ch GmbH (hereinafter referred to as “lakefly.ch”). In order to confirm their registration (online, by phone or on-site), participants take note of these General Terms and Conditions and accept them without reservation. These GTC shall expressly become an integral part of the contract. A participant is the person who takes part in the service provided by Lakefly.ch (hereinafter referred to as the student).

1. Registration and payment:

Registration for the various courses takes place online on the Lakefly.ch website. In special cases it is possible to register on the spot or by phone.

The prices for the Services are quoted in Swiss francs (CHF) and the amounts are net. Lakefly.ch reserves the right to change prices at any time.

Lakefly.ch accepts payments by cards or cash. Payment is due immediately and is made upon confirmation of the online registration on the website or in cash before the start of the course when registering on site (only Swiss francs are accepted). Without prior payment there is no right to participate.

2. Special conditions of participation:

The student commits at the time of registration:

  • – To have accident insurance as well as liability insurance.
  • – To be able to swim in deep water and be in good health.

  • – The mandatory wearing of a life jacket and helmet throughout the

    duration of the course to be observed.

  • – Not to take any valuables with you.

    In case of non-compliance with these points, Lakefly.ch declines any liability and we reserve the right to refuse participation. This also applies to loss, damage or theft in the checkroom.

    Sailing is a sporting activity that is practiced outdoors. It is therefore possible to get wet and/or fall into the water during the course. Lakefly.ch recommends the student to bring equipment adapted to the local conditions. If necessary, Lakefly.ch will provide the student with high quality equipment adapted to the conditions of the region (Helly Hansen and Forward WIP). In the event of damage caused by improper use of the equipment or by gross misuse contrary to the instructor’s instructions, the costs of repair and replacement will be invoiced.

    The course will take place in all weather conditions as long as the safety of the student is guaranteed. The instructor adapts the content of the course and the way of navigation to the weather conditions, level and motivation of the student. The teacher makes the final decision on the implementation.

3. Cancellation:

In case of cancellation on the part of the student, the following regulation applies:

More than 14 days before the start of the course: refund of the full amount of the contract.
14 to 5 days before the start of the course: refund of the amount paid minus 50% of the course price for the processing fee.
less than 5 days before the beginning of the course: no refund will be given

Upon presentation of a medical certificate, we will initially offer to reschedule the course to a later date at no additional cost. In the event of a definitive cancellation upon presentation of a doctor’s certificate, we will refund the time already worked on a pro rata basis.

Only Lakefly.ch is entitled to permanently cancel or prematurely terminate the course for safety reasons or if the sold service cannot be provided. Only in these exceptional circumstances can we, at our discretion, offer to reschedule the course to a later date or, if this is not possible, refund them pro rata for the time already spent.

4. Safety:

If you wish, we will provide you with equipment adapted to the weather conditions and water temperature. Good equipment is also related to your own safety. The water temperature can be relatively cool even in summer. High speeds can be reached when sailing and especially when foiling. That’s why we made a conscious decision to make wearing a helmet mandatory. The life jacket is required by law. The instructors and the sailing school cannot be held responsible for any injuries. Insurance is the responsibility of the student.

We carry out all courses and offers, provided that safety is guaranteed. With sufficient wind, sailing or foiling is possible without any problems. Exceptions are thunderstorms or storms.

5. Liability:

Our dinghies as well as the rental equipment are of the highest quality. Each user receives instruction on the correct use of the material. In case of damage caused by improper use of the equipment, non-observance of the instructor’s instructions or disregard of the right of way rules, the repair, recovery and replacement costs will be charged.

The course starts and ends at the time agreed upon at the time of booking. In the event of a delay, the course will not be extended beyond the time specified at the time of booking. The student is responsible for arriving at the meeting point at least 20 minutes before the start of the course in order to have enough time for preparation (selection of equipment).

6. Personal data:

The student of Lakefly.ch is hereby informed that his/her personal data received in the course of his/her business will be treated in accordance with the provisions of the Swiss Data Protection Act.

7. Photo and video:

The student of Lakefly.ch agrees upon registration that Lakefly.ch may use all photos and videos taken during the course for Lakefly.ch communication channels (flyers, posters, website, social networks, etc.). Lakefly.ch is committed to maintaining the integrity of the student and will only publish photos that are used to promote its own business activities. If someone does not want to do this, this must be mentioned and no photo-video material will be created.

8. Place:

The courses are offered from the Beach Club in the municipality of Sils and on the adjacent body of water, Lake Silvaplana.

9. Applicable law and place of jurisdiction:

Swiss law is exclusively applicable. The place of jurisdiction is St. Moritz in Graubünden.
